The Arsenal Companies are a diversified consulting and educational group dedicated to service in the real estate industry. With national reach, regional strength and local sensibilities, it serves and services large and small companies as well as governmental entities in matters such as acquisitions, dispositions, leasing, licensing, contracting, procurement and collections.
Highly focused. Highly specialized. Highly respected.
The Contracts and Procurement Services Division provides solutions and services that help real estate owners and companies effectively manage their contractual needs and commitments. Whether you are a property, facility or asset manager, your functions are integrally related to real estate contracts.
Doing your job well – providing quality management and administration – involves your ability to bridge the gap between what you know and what you need to know. It involves knowledge, style, experience and contacts AND, more and more, it involves significant skills in contract negotiation and management.
Property Management: The generation of income for the owner while improving or preserving the value of an investment property. Much more than showing space, executing leases and collecting rents, property management requires a versatile knowledge base including market analysis, sales, accountancy, and maintenance engineering as well as communication and diplomatic skills to deal effectively with owners, prospects, tenants, employees, contractors and others in the real estate business.
Quality property management is ALL ABOUT CONTRACTS!
Facility Management: The practice of coordinating the physical workplace with the people and work of the organization. It integrates the principles of business administration, architecture and the behavioral and engineering sciences.
Quality facility management is ALL ABOUT CONTRACTS!
Asset Management: The financial management of a portfolio of investment properties. The asset manager monitors the real estate portfolio in the same way a financial manager oversees a securities portfolio. He/she should be well grounded in the fundamentals of property management to understand the diversity and complexity of the factors bearing upon the supervised portfolio.
Quality asset management is ALL ABOUT CONTRACTS!
We practice deal facilitation rather than obstruction – We adopt a business focus and apply strategic and tactical approaches to ensure that you achieve your outcomes. We will recommend “how to do it” rather than advise “why you can’t do it”.
We provide industry knowledge – There’s no substitute for experience. We have encountered most situations before and are well equipped to understand your business issues and to find practical solutions. We know the best and worst of business models and transaction structures. We can assist you to evaluate and adjust your approach to optimize outcomes.
We provide access to our resource network – We have strong connections throughout the real estate industry. Where appropriate, we can introduce you to prospective business partners, customers and suppliers.
Do you have contract issues that call out for review, interpretation and the advice of a specialist? Do you have a service contract which is about to expire and will need to be renewed or replaced? Do you have oversight of a real estate or facilities function which has been given savings targets? Have you considered ‘outsourcing’ this part of your real estate function but fear a loss of control?
We speak Real Estate.
Vague or unclear contracts are just the beginning of poor communication between a contractor and client. It doesn’t take much for a little miscommunication or misunderstanding to snowball into an avalanche of problems that are expensive and disruptive to your business. Our service is designed to cope with such problems. We will advise you of potential concerns in the agreements you now have and recommend language changes to assist in the prevention of problems before they occur or as contracts are renewed. We provide cost effective advice. Our ability to deliver high quality services rapidly is unrivaled. That is the heart of our contract negotiation service.
Acquisitions, dispositions, renewals, surrenders, amendments, abstracting, administration, interpretation – our professionals are experienced in residential, commercial, industrial, professional and retail leasing issues of all kinds – because we’ve been there.
“Leases are highly specialized documents. A few words can make a world of difference.” (Anyone with experience)
Don’t assume that problems won’t occur. Plan what you can do to avoid them. A small reduction in costs can be the equivalent of a substantial increase in value. We suggest ‘refinements’ to improve language and reduce direct and indirect costs.
Our attorneys (and we don’t charge extra for them) have successfully resolved leasing issues for both small and Fortune 100 corporations – effectuating $millions in savings.
We Speak The Language of Real Estate
Property Management – Facility Management – Asset Management It’s a matter of perspective…It’s about knowledge and style, experience and contacts AND it’s all about CONTRACTS! Property/facility professionals must be equipped with a tremendous amount of knowledge and the ability to cope with and solve a multitude of complex problems and challenges. It is not reasonable to expect them to be experts in contracts as well. Are the contracts for services and supplies which your organization uses prepared for your organization – or are they the vendor’s or contractor’s agreement forms? Wouldn’t you be better off if those agreements and purchase orders were revisited from your perspective? Isn’t it time you fortified your real estate related contracts
CONTRACT NEGOTIATION SERVICES
We analyze the details of your proposed service contracts before they begin, while you still have leverage. Or, we can review your existing service contracts, help reveal cost efficiencies or savings opportunities and set up a database to help ensure quality results and monetary savings. We look for pragmatic solutions that are sensitive to your business interests, anticipating issues that may arise. We will assist in minimizing those risks that cannot be avoided.
First, we discuss your concerns and issues with you. Then we review the pending contract(s) and propose any necessary revisions. (You select which contracts you would like us to review.) We give you specific advice and, with your permission, negotiate a renewal, replacement or extension of contract with your current vendor or one of similar size and stature that provides the same product or service.
The fee structure is reasonable – even possibly performance-based.* Based upon your current annual cost for the product or service, we receive 50% of any savings we are able to negotiate for the next annual period and 25% of the savings for years 2, and 3. By way of illustration:
A small reduction in costs can be the equivalent of a substantial increase in sales. We suggest refinements to improve procedures and reduce costs.
*Performance based remuneration is subject to negotiation and is subject to a variety of considerations including the number and value of the contracts involved.
